Hawaii State Legislature / March 19, 2015 / Honolulu Mayor Kirk Caldwell and HART claim we are committed and obligated to build steel wheel rail to the full 34-mile segment if any more money comes their way and no other rail technology other than steel wheel rail shall be utilized for extensions to UH Manoa, Waikiki, and Kalaeloa - if this is not a truthful statement - then funding the tax extensions per House Bill 134 and Senate Bill 19 will NOT lock us into steel wheel rails and WE will vote on the rail technology for the extensions- right? Confused? Don't be- watch the video! People respond with testimony: "YOU ARE RIPPING US OFF- WE HAVE A RIGHT TO 21ST CENTURY RAIL." HART will not answer any letter, email, testimony, neighborhood board interaction whatsoever- they refuse to answer my question which is- could we then have changed the rail system technology from steel wheel to maglev before we signed the contract? CRUX OF THIS VIDEO: So why then, did Councilman Ikaika Anderson make a conflicting statement that we lost our ability to change the rail system technology before November 2, 2011, when Resolution 11-328 was heard to put urban maglev rail on the ballot for the people to decide? This was BEFORE the FTA even approved our FINAL DESIGN- so how could we forfeit a rail technology of a system whereby the rail system- the design for it- has not even been approved yet by the feds- this is the PERRY MASON MOMENT evidence to win a lawsuit and expose this fraud. Which is it- we lost our right to change rail systems before 2011 when the people had the right to react to Governor Lingle's report- or is it rather when we signed the contract calling for a steel wheel system on December 19, 2012? Our right to magnetic levitation rail has been wrongfully denied. The terms of the FFGA contract have been misrepresented to the citizens of the City and County of Honolulu- and therefore, a class action lawsuit is pending based upon HB134 HD1 SD1 and or SB19 SD1 passing the Hawaii State Legislature of which bills in their current forms seeks to compound the harm. The FFGA has been misrepresented and mischaracterized by policy makers that the people (grantee) had no right to amend the contract before it was signed to allow magnetic levitation rail systems. The video captures former Honolulu City Councilman Tom Berg and producer of the television series "SAY YES TO BETTER RAIL" and also "LET'S SWITCH TO URBAN MAGLEV" giving testimony on SB19 heard on March 4, 2015- "You have DIRTY HANDS." Why not get a rail column that doesn't penetrate the sensitive places of known or unknown iwi, the water table, the karst, and with a smaller footprint, makes no noise....and between midnight and 4am when the passenger rail is not in service, generate revenue moving goods, services and freight from our harbors, hubs, and farms to the places of destination whereby in result, we actually get traffic relief with less trucks on the road...they would have the option instead to utilize the maglev rail line for a fee permitted in the FFGA and Charter. Why is it then, that this more efficient, superior rail technology known as maglev- is being suppressed by Honolulu and the state of Hawaii's legislature? This video attempts to answer that question. Video contains footage of LEVX rail recognized by the United Nations- previously published videos feature other maglev rail providers- all are superior to our steel wheel rails.....so why plow on with outdated, overpriced, obsolete, noisy, heavy steel wheel rail for paradise? A public meeting on the subject would illustrate what magnetic levitation can do better, for less.
