Description

On 5th May 2011 Irene Nanteza was rushed here to Mityana Hospital to deliver her baby but she did not make it. She died alongside her unborn child. Nanteza was in labour for about five hours and later needed an operation but the doctor who was on duty then, one Mubeezi could not be found to help her deliver. Due to the pro-longed labour pain, Nanteza and her unborn baby passed away. The sad deaths prompted an NGO, the Centre for Health, Human Rights and Development (CEHURD) to sue doctor alongside the hospital for criminal negligence that led to Nanteza's death. High Court Judge Benjamin Kabiito who is hearing the case visited the hospital for an on-the spot assessment of the facility. The visit was prompted by the contradictory evidence submitted by Ester Nanfuka, the midwife who was also on duty on the fateful day. She was a witness of the hospital. In her testimony on 13th February, the midwife told court that when Dr. Mubeezi was urgently needed to attend to the deceased, he was within the hospital premises but she could not locate him. During his visit, Justice Kabiito toured the administration block, the maternity and labour wards as well as the main operating theater. The judge sought to ascertain the distance from where the doctor was allegedly stationed at the time, the outpatient ward and the main operating theater where the deceased lay in pain while waiting for the doctor. The petitioners are seeking general damages and compensation from the state, saying Nanteza's right to life was violated through criminal negligence, which is a violation of the constitution.
