Description
The current embattled relationship between the AU and the International Criminal Court (ICC) has re-emerged following the decision by the government of Malawi to cancel initial plans to host the Summit in Lilongwe. This decision was informed by the insistence of the AU to invite Sudan's President Omar al-Bashir to the Summit despite the existence of an ICC warrant for his arrest for alleged war crimes, ethnic cleansing and crimes against humanity. During the summit, there will be a consideration of the draft Protocol on the African Court of Justice and Human Rights. In Addis Ababa, the 9th African Union summit is underway. Heads of State and Government are expected over the weekend to deliberate on and ratify a proposal to enhance the jurisdiction of the African Court of Justice to deal with criminal matters. The latter will include consideration for the expansion of the mandate of the court to include criminal jurisdiction. This significant development is an outcome of a process initiated by Rwanda which led to the 2009 AU Assembly decision on the abuse of the principle of Universal Jurisdiction. The realization of such an African-led solution on the question of justice within the continent will garner momentum, receive credibility, and most likely succeed through the unity of Africa's voice.
