Prosecution on Uhuru’s case faults president’s lawyers on excusal request

In response to President Uhuru Kenyatta's request to be excused from being present in The Hague courtroom, the prosecution faulted the presidents lawyers for basing their application on an article that gave the provision to apply for excusal from presence and use of video technology, only during trial. This case had not reached the trial stage yet. Regardless, the prosecution said it is up to the chamber to make a decision on the application depending on what was scheduled to be discussed in the status conference. On their part, the lawyers of the victims opposed the request for excusal from attendance, but agreed to the application to have the status conference adjourned to a later date, where the accused would be compelled to attend in person. The President's lawyers Steven Kay and Gillian Higgins, asked ICC judges to lift the requirement for his attendance on October 8th 2014, citing State engagements in Kampala, Uganda, scheduled for the same day.
